HELMET LIABILITY WAIVER

Important Safety Notice

No helmet can protect the wearer from all foreseeable or unforeseeable impacts, collisions, injuries, or other hazards. A helmet is designed to reduce the risk or severity of certain injuries, but it cannot guarantee protection from serious injury, permanent disability, or death.

Helmet performance depends on many factors, including the type, location, and severity of an impact, proper fit and positioning, correct use, condition of the helmet, and other circumstances surrounding an incident.

Your Responsibility

By purchasing, using, or participating in activities involving this product, you acknowledge that:

• You understand that helmet use does not eliminate the risk of injury or death.
• You will use a helmet that is appropriate for the intended activity and properly fitted and secured.
• You will follow the helmet manufacturer's instructions, warnings, and recommendations.
• You will inspect the helmet before each use and will not use a helmet that is damaged, improperly fitted, or otherwise unsuitable.
• You understand that a helmet may need to be replaced after an impact or in accordance with the manufacturer's replacement recommendations.
• You are responsible for using the product safely and in accordance with applicable laws, regulations, and safety requirements.

Assumption of Risk and Release

To the fullest extent permitted by applicable law, you acknowledge and voluntarily assume the risks associated with using a helmet and participating in activities for which the helmet is intended. You agree that Iron Pony Motorsports Group, Inc, its owners, officers, employees, affiliates, and representatives are not responsible for injuries, damages, losses, or claims arising from risks that cannot legally be excluded or limited, subject to applicable law.

Nothing in this waiver is intended to waive, exclude, or limit any right, remedy, warranty, or liability that cannot legally be waived, excluded, or limited under applicable law.
